10. Third-Party Links and Affiliate Disclosure

10.1 Third-party links

The Website contains links to third-party websites and services. These are provided for your convenience only. We do not control and are not responsible for the content, availability, terms, or privacy practices of third-party websites. Accessing them is at your own risk, and we recommend reviewing their own terms and privacy policies.

10.2 Affiliate and commercial relationships

Some links on the Website may be affiliate links, meaning the Operator may receive a commission if you make a purchase or sign up through them, at no additional cost to you. Where required by Law no. 363/2007 on combating unfair commercial practices and applicable EU consumer law, such commercial relationships are disclosed on the relevant pages. Editorial opinions remain independent of any affiliate relationship.

11. Interactive Features and User Submissions

Where the Website allows Users to submit content (for example, through contact forms or comments, if enabled):

  • you retain ownership of your submissions but grant the Operator a non-exclusive, royalty-free license to use them for the purpose for which they were submitted;
  • you warrant that your submissions do not infringe third-party rights and do not contain unlawful content;
  • we reserve the right to refuse, remove, or not respond to submissions at our discretion, in compliance with applicable law, including Regulation (EU) 2022/2065 (Digital Services Act) to the extent applicable.

To report content on the Website that you believe is unlawful or infringes your rights, contact us at the email address in Section 1. We will review notifications diligently and in good faith.

12. Availability of the Website — No Warranty

The Website is provided "as is" and "as available". While we take reasonable measures to maintain its availability and security, we do not warrant that:

  • the Website will be available without interruption or error;
  • defects will be corrected within any particular timeframe;
  • the Website or its hosting infrastructure will be free of vulnerabilities or harmful components.

We may modify, suspend, or discontinue the Website or any part of it at any time, without prior notice.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • the Operator shall not be liable for indirect or consequential damages, loss of profit, loss of business opportunity, or loss of data arising from the use of, or inability to use, the Website or reliance on its Content;
  • the Operator shall not be liable for damage resulting from third-party websites, services, or content accessed through links on the Website;
  • the Operator shall not be liable for events of force majeure or fortuitous events as defined by the Romanian Civil Code (Law no. 287/2009).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Romanian law, including liability for damage caused by intent (intenție) or gross negligence (culpă gravă), or any mandatory rights granted to consumers under applicable consumer protection legislation (including OG no. 21/1992 and OUG no. 34/2014, where applicable).

14. Consumer Information

If, in connection with the Website, you act as a consumer within the meaning of Romanian and EU consumer law, you benefit from all mandatory consumer rights, which these Terms do not restrict.

Complaints may be addressed:

  • directly to the Operator at the email address in Section 1 — we aim to resolve any issue amicably first;
  • to the National Authority for Consumer Protection (ANPC)anpc.ro; consumers may also use the alternative dispute resolution (SAL) mechanism through the ANPC's SAL Directorate, in accordance with OG no. 38/2015 on alternative dispute resolution between consumers and traders.

15. Amendments to These Terms

We may amend these Terms from time to time, for example to reflect legislative changes, new Website features, or changes in our practices. Continued use of the Website after publication constitutes acceptance of the amended Terms. For material changes affecting registered newsletter subscribers, we may additionally provide notice by email.

16. Governing Law and Jurisdiction

These Terms are governed by Romanian law and applicable European Union law.

Any dispute arising from or in connection with the use of the Website shall be submitted, after a good-faith attempt at amicable resolution, to the competent courts of Bucharest, Romania — except where mandatory legal provisions (in particular consumer protection rules under Regulation (EU) No 1215/2012) establish a different competent court in favor of a consumer.

17. Miscellaneous

  • Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision shall be replaced by a valid one that most closely reflects its intended purpose.
  • No waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Entire framework: These Terms, together with the Privacy Policy and the Cookie Policy, represent the complete framework governing the use of the Website. Separate written agreements govern any professional services engagement.
  • Language: These Terms are drafted in English for the convenience of the Website's international audience. In the event of a dispute before Romanian authorities or courts, a Romanian translation may be provided; questions of interpretation are resolved under Romanian law.
